William Perry was indicted Tuesday on two counts of aggravated murder in the death of 34-year-old Brett Smith. He could be sentenced to death if convicted.

Smith's body was found Oct. 4 by another neighbor. County Prosecutor John Ferrero says a coroner's report shows Smith died of asphyxiation.

Perry was also charged with gross abuse of a corpse, aggravated robbery, aggravated burglary and tampering with evidence.

Perry has been jailed since Oct. 7 after investigators said he damaged the electric meter box for Smith's home.

Perry's attorney Anthony Koukoutas says he hasn't spoken with his client about the new charges.

Perry was previously convicted of unrelated aggravated assault and a firearms charges.
