MIDDLETOWN, Ohio -- An appeals court has overturned a 13-year-old boy's rape conviction because police violated his rights during questioning.
The Ohio 12th District Court of Appeals in Middletown ruled that police in Clermont County's Union Township failed to read the boy his rights and refused to let his father witness the interrogation.
The Cincinnati Enquirer reports that the court sent the case back to Clermont County Juvenile Court for further action Tuesday.
Last year, a juvenile court judge decided that the boy wasn't under arrest when police questioned him and therefore didn't need to be advised of his rights.
Court records do not indicate the age of the girl who the boy was convicted of raping in the 2009 incident.
