Dimora trial: Jury returns Tuesday to hear all charges

AKRON -- After having Monday off, jurors return to U.S. District Judge Sara Lioi's courtroom Tuesday to get their jury instructions and listen while Lioi recites the 37-charge indictment against Jimmy Dimora and Michael Gabor.

Jimmy Dimora, 56, of Independence, is the former Cuyahoga County Commissioner charged with racketeering, bribery and conspiracy. Gabor, 52, of Parma is a former Cuyahoga County Auditor's office employee charged with eight counts, including racketeering, bribery and conspiracy.

Both pleaded not guilty.

Monday saw only Lioi, the defendants and their attorneys in the courtroom finalizing jury instructions and arguing points as to the wording of the instructions.

Starting at 8:30 a.m. Tuesday, the seven-man, five-women jury, along with the five alternates, returns as Lioi will deliver the jury instructions to the jury and recite all the charges, something that is expected to take most of the day, Lioi said.

Starting at 8:30 a.m. Wednesday, closing arguments will begin, with Assistant U.S. Attorney Antoinette Bacon delivering the closing argument for the prosecution. Her argument is expected to last several hours.

Then Dimora's defense attorneys, either Andrea or Bill Whitaker, will deliver their closing argument to finish off the day.

Starting at 8:30 a.m. Thursday, Gabor's attorney Leif Christman is scheduled to deliver his closing argument, followed by the government's rebuttal.

We expect the jury to get the the case for deliberation sometime Thursday afternoon or first-thing Friday morning.
