Dimora's co-defendant wants out as well

CLEVELAND -- Michael Gabor today asked U.S. District Court Judge Sara Lioi to get out of jail until he is sentenced in July.

Gabor was convicted along with former Cuyahoga County Commissioner Jimmy Dimora on March 9.

In support, Gabor said he "has maintained his innocence and will not jeopardize his appeals nor subject himself to sentencing enhancements by attempting to flee."

He also has strong ties to the community, Garbor argues.

"He has lived in the same house with his mother for his entire life," Gabor's attorney Leif Christman noted in the request submitted Thursday.

"He has a wife and sone who also live at the same address."

Dimora has already asked to be let out of jail pending his sentencing. The judge is considering the request after doctors found a mass in the back of Dimora's throat while he was hospitalized for three days following a May 4 fall at the Northeast Ohio Correctional Center in Youngstown.

Doctors at St. Elizabeth's in Youngstown found a mass in Dimora's throat that needs further medical examination to see if it is cancerous or not, his attorneys said. 

Prosecutors said they would agree to an earlier sentencing date than July for Dimora so that he could immediately receive medical treatment at a federal prison medical center.
