O'Malley's plea, upon reading the information filed Monday in federal court, will be based on whether he told the truth to FBI and IRS investigators, and whether or not he reported criminal conduct.
"Informations" are filed instead of indictments when the defendant has worked with prosecutors and a plea deal has been worked out.
Federal prosecutors allege that O'Malley had knowledge of a felony and didn't report it. O'Malley knew of this in 2006 but subsequently lied about it the FBI and the IRS.
All of the actions alleged in the federal information occured before O'Malley was hired in North Royalton.
The information relates to the nearly two-year probe into alleged corruption in Cuyahoga County government.
