CLEVELAND -- Everyone assumed that when Tom Condosta's office door was closed at the Cuyahoga County Public Defender's office, he was busy doing legal work for those who could not afford their own attorney.
But Channel 3 News Investigator Tom Meyer has learned that Condosta is accused of taking photographs of a completely naked female client inside his county office across from the Justice Center downtown. Condosta is also accused of posting the nude photos on a pornographic website.
Condosta denied the allegations. "I've never done such a thing with a client," said Condosta. "I would never have an inappropriate relationship with a client."
The female client agreed to speak with Meyer on the condition her name not be disclosed. She said there's no question that Condosta represented her in a case in which she said he would help her get a felony conviction overturned or at least have the case re-opened.
"I felt desperate. I knew it was wrong. I knew this was outrageous," she said when asked about why she agreed to pose nude. "He was very specific on how he wanted me to pose," she said.
"His idea was to post them on a website and I would potentially get money from a contest," she said.
In addition to taking what she says was about 50 nude photos, she said Condosta also made sexual advances inside his county office. She said Condosta touched her in her private areas, but she said she told him to stop.
The female client reached out to the FBI to investigate, but she says they suggested she go the the county sheriff. The sheriff's office looked at the case and determined it should best be handled by the public defender's office.
On the day Condosta denied he was disciplined by Chief Public Defender Robert Tobik, Channel 3 News learned he was actually fired. A spokesman for Tobik said Condosta was even placed on administrative leave the week prior to his firing.
Condosta has served in the public defender's office for 24 years,and made $90,187 a year. Tobik had no comment until the case is officially closed. An appeal is pending.
