Dimora trial: Feds post list of exhibits they will release

AKRON -- Federal prosecutors responded to U.S. District Court Judge Sara Lioi's order and posted two lists of Jimmy Dimora trial exhibits Tuesday afternoon that they believe can be released to the media and the public.

Attorneys for the two defendants have until Friday to respond to the lists with either agreement or objections. Then Lioi will decide what and how items are released.

Exhibit A lists the government's exhibits which, in the government's view, would be subject to disclosure pursuant to this court's order. (See attached link for Exhibit A complete list)

Exhibit B lists the government's exhibits which, while subject to disclosure pursuant to this court's order, would require redaction prior to disclosure. (See attached link for Exhibit B complete list)

Redaction means removal of sensitive information, like Social Security numbers and credit card numbers, or blurring the faces of unrelated people or bystanders in photographs.

For example, there was a photograph that showed, in addition to Dimora and his friends, unidentified topless women lying around the Bare Pool at the Mirage Hotel in Las Vegas. Those women's faces and upper bodies would need to be blurred to avoid recognition.

The Bare Pool is a private area where women can be topless. Dimora and his group of friends were using a paid-for cabana at the Bare Pool.

The Exhibit A List includes:

  • 16 basic I.D. photos, showing Dimora, former Cuyahoga County Auditor Frank Russo, , former county employee Michael Gabor, businessman Steve Pumper, former county employee J. Kevin Kelley and others;
  • Three exterior photos of the Stonebridge condominium complex where Dimora and others played poker and where Dimora met with prostitutes;
  • Exterior photographs of Delmonico's steak house in Independence, the Doubletree Hotel/Shula's steak house in Independence, the Holiday Inn  Rockside in Independence, the back room of Teamz restaurant in Berea;
  • Photographs of various businesses referred to in Dimora's trial, photograph of Dimora's kitchen refrigerator;
  • The Mirage hotel bills for Domora, businessman Ferris Kleem, Russo, Kelley, Pumper and Gabor;
  • Video of limousine at Mirage Hotel, surveillance video of Dimora and friends at the Prime Steak House in the Bellagio hotel in Las Vegas;
  • Dozens and dozens of photographs taken inside and outside Dimora's Independence home when it was raided July 28, 2008, including his back yard "resort" with its pizza oven, Tiki bar, etc;
  • Receipts for "sponsor" dinners at various restaurants, including Brio and the Metropolitan;
  • Details and planning for Lori Dimora's 50th birthday party at Executive Caterers at Landerhaven;

The Exhibit B List, which would need sections of each exhibit redacted, includes:

  • Michael Gabor personnel file, casino records from casinos in New Orleans and Windsor, Ontario, Canada
  • photograph of Nevada driver's license belonging to Suzzanne Michaels, the $1,000 prostitute Ferris Kleem paid for Dimora in Las Vegas;
  • Dozens and dozens of limousine records and credit card payments for about $14,000 worth of limousine rides provided to Dimora and his family by former county engineer's office employee Kevin Payne (now deceased);
  • Holiday Inn records for Gina Mueti Coppers from her sexual tryst with Dimora at the Holiday Inn in Independence and her resume that she faxed to Dimora to get a job;
  • Bank records and credit card receipts for about 14 people and businesses involved in the trial

Dimora, 56, of Independence, was found guilty of 33 of 34 counts on March 9 and is being held in the Northeast Ohio Correctional Center in Youngstown until his July 25 sentencing.

Co-defendant Michael Gabor, 52, of Parma, was found guilty of 7 of 8 counts, is also at NOCC and will also be sentenced July 25.
