Appeals court denies Dimora appeal, trial starts Thursday

AKRON -- The Sixth Circuit Court of Appeals in Cincinnati has denied former Cuyahoga County Commissioner Jimmy Dimora's appeal to halt his corruption trial.

Late Tuesday the appeals court denied his appeal that going forward with the trial would violate his Fifth Amendment rights.

A three-judge panel from the Sixth Circuit said his rights have not been violated and that the issue of "double jeopardy" does not exist.

In an excerpt, the ruling stated "Dimora has not shown a clear and indisputable right to a stay of the jury trial pending his appeal."

U.S. Attorney spokesman Michael Tobin confirmed that U. S. District Judge Sara Lioi has ordered Dimora's trial to begin Thursday morning at 8:30 a.m..
